Morgan  Hill issues new permit for illegal golf course

Despite protests from Committee  for Green Foothills, Santa  Clara Valley Audubon Society , and others, the City of Morgan Hill  issued on April 21 yet another "temporary" use permit (TUP) for the illegal  golf course constructed near Corralitos Creek.

 This permit will allow the American Institute of  Mathematics (AIM) to continue to water and maintain their golf course  despite the fact that the course, on land that provides habitat for several  endangered plants and animals, was built without permits and lacks an  approved Environmental Impact Report. Once the owners meet the conditions  in the city's previous TUP, which expired in March 2004, they will also  be allowed to play golf on the course even if other state and federal  environmental regulations continue to be violated.

The city's decision to issue the permit, one in a string of successive permits granted to AIM officials and John Fry (owner of Fry's Electronics), indicates continued leniency on the part of Morgan Hill. Environmentalists agree that this pattern sets a terrible precedent for enforcement of environmental regulations, and are looking to shut down the course until environmental review and mitigation are complete.

 Committee for Green Foothills and the Santa Clara  Valley Audubon had asked  the city not to issue the TUP for the project, which poses serious  threats to local water supplies and endangered species. The groups are  consulting with attorneys to determine the best way to ensure that environmental  protections are upheld.
